Fabric Kit Additional Terms

The Fabric Kit Additional Terms (“Additional Terms”) govern your use of Fabric Kit (“Service”) and are incorporated in reference to the General Terms of Use (“General Terms”) (the Additional Terms and the General Terms are collectively referred to as “Terms”). Capitalized terms not defined here have the same meaning as defined in the General Terms. References to “Services” in these Additional Terms are to Fabric Kit related services.

  1. License to use our Service. Subject to your compliance with these Additional Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to use the Fabric Kit.

  1. Limited Warranty. CLO warrants that the Fabric Kit will be free in all material respects from manufacturing defects, under normal and intended use as described in the Fabric Kit Manual furnished by CLO (“Documentation”), for a period of one (1) year from the date of acceptance of the Fabric Kit (“Warranty Period”). No extended or additional warranties are provided beyond the Warranty Period.

  2. Inspection. You shall inspect the Fabric Kit within seven (7) calendar days after delivery ("Inspection Period"). If you identify any defects, shortages, or non-conformities, during the inspection period, you must notify CLO immediately in writing, providing reasonable details and supporting evidence of the defect (“Defect Notice”). Upon receipt of such notification, CLO shall, at its sole discretion, repair or replace the defective Fabric Kit at no additional cost to you, provided that you return the defective Fabric Kit in accordance with the Fabric Kit Return and Exchange Procedures set forth in Section 5. If you fail to notify us within the Inspection Period, the Products shall be deemed accepted and free from any defects or non-conformities, except for latent defects not reasonably discoverable upon initial inspection.

    3.1 Acceptance Based on Incoterms. The date of delivery and acceptance shall be determined as follows:

    1. DDP (Delivered Duty Paid): For Fabric Kit delivered under DDP terms, delivery is complete when the Fabric Kit arrives at the designated delivery location, cleared for import, with all duties and taxes paid by CLO. The Inspection Period begins upon receipt of the Fabric Kit at the delivery location. If no Defect Notice is provided within the Inspection Period, the Fabric Kit shall be deemed accepted.

    2. DAP (Delivered at Place): For Fabric Kit delivered under DAP terms, delivery is complete when the Fabric Kit arrives at the designated location, but you are responsible for import clearance, duties, and taxes. The Inspection Period begins when you take possession of the Fabric Kit at the agreed location. If no Defect Notice is provided within the Inspection Period, the Fabric Kit shall be deemed accepted


  3. Warranty Claims and Remedies. If you identify any defects in the Fabric Kit within the Warranty Period, you shall promptly notify CLO in writing, providing reasonable details and supporting evidence of the defect. After examining the defect, and if CLO determines that such defect is due to CLO’s default and is not one of the exclusions listed in Section 4.1 (Exclusions and Limitations), CLO shall, at its sole discretion, either: (a) repair or replace the defective Fabric Kit at no additional cost to you; or (b) provide an alternative remedy, such as a partial refund or credit, as mutually agreed between the parties.

    4.1 Exclusions and Limitations. The warranty under Section 4 shall not apply to the extent that the alleged warranty breach results from: (a) damage resulting from mishandling, abuse, misuse, accident, negligence, or the your failure to properly calibrate the Fabric Kit or follow installation or operating instructions, (b) normal wear and tear, (c) defects caused by alterations, modifications, repair and servicing not made or authorized by CLO, (d) damage caused by handling, operating, storing, and using the Fabric Kit outside the permitted or intended uses described in the Documentation, including but not limited to use in wet conditions, (e) defects that are not reproducible by CLO, and (f) batteries used in the Fabric Kit. Actual battery life varies depending on use. This warranty is also void and does not apply if you open the casing of any Fabric Kit. The warranty under Section 4 becomes void if the Fabric Kit is result or transferred to a third party without prior written notification to and approval from CLO. The warranty applies to the original purchaser and is non-transferable without CLO’s explicit consent.


  4. Fabric Kit Return and Exchange Procedures. To return a defective Fabric Kit and qualify for a warranty remedy, you must follow the procedures below. If these procedures are not followed, CLO will not be able to accept the defective Fabric Kit or provide you with a warranty remedy.

    5.1 The Fabric Kit must have been purchased directly from CLO.

    5.2 You must compose an email with the following details and send it to CLO's designated customer service contact (support@clo3d.com). Any missing or inaccurate information may result in a delay or denial of your request:

    1. Your Name;

    2. Address;

    3. Phone Number;

    4. Email Address;

    5. Detailed reason for the return request (including photos or videos, if applicable). Upon receipt of your request, CLO will review the information and once your request is approved, you will receive a Return Merchandise Authorization (“RMA”) number and shipping information. Returns without a valid RMA number will not be processed;

    6. The returned Fabric Kit must be accompanied by a copy of the RMA;

    7. A copy of the original order confirmation must be included; and

    8. All original packaging must be included.
