Fabric Kit Addtional Terms

The Fabric Kit Additional Terms (“Terms”) govern your use of the Fabric Kit (“Service”) and are incorporated in reference to the General Terms of Use (“General Terms”) (the Additional Terms and the General Terms are collectively referred to as “Terms”). Capitalized terms not defined here have the same meaning as defined in the General Terms. References to “Services” in these Additional Terms are to the Fabric Kit.

  1. Equipment Warranty

    1.1 Covered Components: CLO Fabric Kit components covered by this Limited Warranty (refer to the Components Section in the Fabric Kit Manual) are Stretch Test Device, Bending Test Device, Thickness Gauge, Stencil, Scale, and Charging Adapter.

    CLO warrants you that the components of the CLO Fabric Kit described above (each, a “Covered Component”) will be free in all material respects from manufacturing defects, under normal and intended use as described in the Fabric Kit Manual furnished by CLO (“Documentation”), for a period of one (1) year from your original date of purchase of the CLO Fabric Kit, from CLO (“Warranty Period”). 

    If a Covered Component fails to conform to the foregoing warranty and CLO receives a valid written claim within the Warranty Period, CLO will, at CLO’s option and expense: (a) use commercially reasonable efforts to repair or replace the defective Covered Component or part with a new or refurbished Covered Component or part, or (b) accept the return of the Fabric Kit and refund  the full original purchase price of the Fabric Kit. The foregoing warranty is CLO’s sole obligation and your sole and exclusive remedy for any defects in a Covered Component. Repair or replacement of a defective Covered Component or part does not extend the original Warranty Period for such Covered Component.

    1.2 Exclusions and Limitations. This warranty is void and does not apply to: (a) damage resulting from mishandling, abuse, misuse, accident, negligence, or the your failure to properly calibrate a Covered Component or follow installation or operating instructions, (b) normal wear and tear, (c) defects caused by alterations, modifications, repair and servicing not made or authorized by CLO, (d) damage caused by handling, operating, storing, and using the Fabric Kit outside the permitted or intended uses described in the Documentation, including but not limited to use in wet conditions, (e) defects that are not reproducible by CLO, and (f) batteries used in a Covered Component. Actual battery life varies depending on use. This warranty is also void and does not apply if you open the casing of any Covered Component. 

    1.3 Instructions to Obtain Warranty Service. In order to receive any remedy under this Limited Warranty, you must follow CLO’s RMA Procedures (See Fabric Kit Return and Exchange Policy).

    EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLO DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE FABRIC KIT AND ANY COVERED COMPONENT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLO ALSO LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CLO, NOR ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS (COLLECTIVELY, THE "CLO PARTIES") BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF OR INABILITY TO USE THE FABRIC KIT OR ANY COVERED COMPONENT, HOWEVER CAUSED,  OR THIS LIMITED WARRANTY, AND UNDER ANY THEORY OF LIABILITY EVEN IF CLO WAS PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL CUMULATIVE ACTUAL DAMAGES TO WHICH YOU MAY BE ENTITLED ARISING FROM OR RELATED TO THIS LIMITED WARRANTY, THE FABRIC KIT OR ANY COVERED COMPONENT SHALL BE LIMITED TO THE AMOUNTS PAID BY YOU, IF ANY, TO PURCHASE THE PRODUCT AT ISSUE FROM CLO. THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM.

    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF STATUTORY OR IMPLIED WARRANTIES, OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN SUCH JURISDICTIONS THE LIMITATIONS AND EXCLUSIONS SET FORTH HEREIN MAY NOT APPLY TO YOU. CONSEQUENTLY, IN SUCH JURISDICTIONS, THE LIABILITY OF THE CLO PARTIES IS LIMITED TO THE EXTENT PERMITTED BY LAW, THEREBY MINIMIZING THE LIABILITY OF SUCH CLO PARTIES TO YOU TO THE LOWEST AMOUNT PERMITTED BY APPLICABLE LAW. THIS LIMITATION IS INDEPENDENT OF ANY OTHER LIMITATION SET FORTH HEREIN. 

    IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.

    1.4 Consumers within the European Union/ European Economic Area. This Limited Equipment Warranty may not apply to consumers within the European Union/European Economic Area. Where inapplicable by applicable law, Consumers within the European Union/European Economic Area are covered by national consumer protection laws or regulations. Thus, the rights of Consumers within the European Union/ European Economic Area with regard to purchase of the Fabric Kit will be governed by applicable national legislation governing the sale of consumer goods.

  2. Fabric Kit Return and Exchange Policy

    2.1 CLO accepts returns and exchanges only in accordance with the above Limited Warranty and Warranty Period.

    2.2 ‘This Policy applies only to the CLO Fabric Kit and the Covered Components described in the Limited Warranty, and not to any other products or services offered by CLO.

    2.3 Only returns that meet the following criteria will be accepted under the Limited Warranty:

    1. The Fabric Kit and all its Covered Components must have been purchased directly from CLO. 

    2. you must obtain a valid Return Merchandise Authorization Number (RMA) by following the procedures specified below. 

    3. In the RMA request, you must specify in detail the reason for the request.

    4. Your return must be accompanied by a copy of the RMA.

    5. Fabric Kit was delivered to you within 12 months of the request.

    6. A copy of the original order confirmation must be included.

    7. All original packaging must be included.

    8. All original accessories must be included.

    9. The Fabric Kit and all accompanying accessories being returned must be returned in the same condition as originally provided to you (for example, free from liquid contamination or other physical damage).

    If your request does not meet all of the above criteria but still wish to make a request, please contact CLO at support@clo3d.com. Under certain circumstances, and in CLO’s discretion, may still be able to process your request.

    2.4 Missing, Damaged or Incorrect Orders. You shall inspect the order upon receipt of it. Despite CLO's best efforts and in the unlikely event your order is incomplete or damaged, please contact CLO immediately at support@clo3d.com. CLO will not accept return or refund requests for damaged or incomplete shipments unless you notify CLO within 3 days of order receipt.

    2.5 Requesting an RMA. Returns are accepted only in accordance with CLO’s Limited Warranty or applicable consumer protection laws (for non-US Companies). 

    2.6 RMA. You shall follow the procedures below to obtain an RMA (Return Merchandise Authorization) number. Any missing or inaccurate information may result in a delay or denial of your request. Compose an email with the following information:

    1. Your name:

    b. Address:

    c. Phone number:

    d. Email address:

    e. Description of the reason for return

    2.7 Email the information to support@clo3d.com. Once your request is approved, you will receive a RMA number and shipping information within 48 hours of the request. Approved returns must be received by CLO within 21 days of the issuance of an RMA

    2.8 Items returned must be securely packaged to prevent loss or damage in transit. A valid RMA number and your return address should be clearly visible on the outside packaging. Postage must be prepaid, and you must be able to track and confirm delivery to CLO. You shall bear all in-transit risk of loss or damage to items returned. If you send items without a valid RMA number prominently displayed on the outside mail packaging, it may be returned to you unopened. 

    2.9 Subject to availability and where applicable, repaired or replacement items will be shipped on the next business day following CLO’s receipt of your returns. CLO will be responsible for the cost of shipping repaired or replacement items back to you under the Limited Warranty.

    2.10 Processing Refunds. Refunds will be issued in the currency of the original order. CLO shall not be liable for any transaction costs CLO incurs associated with the refund. Refunds will be credited to the original form of payment. Please allow up to thirty (30) days after CLO receives the return to process refund.

    2.11 CLO reserves the right to, at our discretion, modify, suspend or terminate this Policy. Any change to this Policy applies to orders made after modifications are posted. All inquiries shall be addressed via  support@clo3d.com.


  3. Trade-in Option

    3.1 You can elect to exchange its existing Fabric Kit with a discounted price of the upgraded version provided that (“Trade-In Option”):

    1. Your existing Fabric Kit is the 2.0 version;

    b. You purchased its existing Fabric Kit since the 1st of January 2023;

    c. You elect to take advantage of the Trade-in Option within 3 (three) years of its initial purchase date (“Trade-In Period”); and

    d. Your existing Fabric Kit is in good condition or reparable.

    3.2 You accept and acknowledge that the Trade-In Option shall be unavailable in the event that CLO, in its sole discretion, deems the Fabric Kit is irreparable or not in good condition, and the Fabric Kit was purchased prior to the 1st of January 2023. 

    3.3 For avoidance of doubt, in the event you elect to exchange the Fabric Kit in accordance to the Fabric Kit Return and Exchange Policy during the Warranty Period, the Trade-In Period shall commence on the date of initial purchase of the Fabric Kit as opposed to the date of the alleged exchange.  

    3.4 You shall solely bear the cost of its delivery of the existing Fabric Kit to apply for the Trade-In Option irrespective of the result of its qualification. CLO shall not have any obligation to provide financial support and/or reimbursement for such delivery or any related incurred expenses.

Delivery term:The terms of delivery shall be "Delivered Duty Paid" (DDP), according to "INCOTERMS 2021" - International Rules for the Interpretation of Trade Terms, subject to the delivery terms, provided that in the event of any conflict between this Terms of Use and Incoterms 2021, this Terms of Use shall govern.
